During the recent years the polish technical-legal system has been intensively adopted to the regulations of the European Union.
Adopting polish law to union's regulations in the field of construction works is a complex process,
as it covers a wide scope of legal problems - starting with regulations related with construction's safety to standards and certificates of compliance for construction wares.
The concept of full implementation of the 89/106/EWG Directive has been presented on the day of Poland being accepted into the European Union.
Implementation of the 89/106/EWG Directive Construction wares has resulted in changes of polish construction law resulting from adopting country regulations to the solutions adopted by the member countries.
Factory Production Control System (FPC) is one of the requirements of the 89/106/EWG Directive,
the possession of which by construction wares' producers is obligatory,
regardless of the adopted compliance assessment system.
Factory Production Control means permanent internal production control,
conducted by the producer.
Introducing the system of Company Production Control should ensure the stability of production and acquiring such characteristics of the product,
which are compliant with the technical arrangements.
The producer is responsible for organizing and implementing the Company Production Control system.
The system should be documented,
and the documentation should be up to date.
A person,
who has the necessary rights for performing the following actions,
should be appointed in the company:
- specifying procedures,
necessary to show the good's compliance at the specific stages of its production;
- identification and keeping records regarding the non-conformities at each production stage;
- specifying the correction actions procedures.
Producer's documentation and the procedures should be appropriate for the product and production process,
and the Company Production Control system should ensure a proper good's compliance level with the requirements of the technical specification.
It covers:
- compiling procedures and instructions related with the operations of Company Production Control;
- effective implementation of these documents,
keeping records of the conducted activities;
- utilizing the records to conduct corrective actions in order to eliminate any non-conformities.
Actions of Factory Production Control cover:
a) control of the resources and components for production;
b) controls and tests conducted during the production process according to the preset frequency;
c) controls and tests of the final wares,
according to the frequency specified in the technical specifications.
Depending on the type of production it may be necessary to perform all the listed actions or just the operations listed in b) and c),
or just in b) or just in c).
The producer should possess appropriate technical competences to conduct controls and tests or should use the services of subcontractors,
who meet the proper requirements.
The producer should conduct supervision of the control,
production,
measurement equipment,
tests conducted in proper conditions.
The measurement devices should be calibrated or controlled and should be used according to the manual.
Goods' tests should be conducted according to the operations' plan,
with the use of methods pointed out in the technical specification. The test methods should be direct.
Indirect methods should be used when determining the correlation between the property,
which is to be specified and a different one,
which is easier to measure,
is possible.
The producer should keep records,
which are the proof of conducting the tests.
They should clearly indicate if the good meets the specified requirements - acceptance criteria.
In the case the good does not meet these requirements,
the producer should undertake the necessary corrective actions,
foreseen in the Company Production Control system.
The goods,
which do not meet the requirements need to be isolated and properly marked.
After eliminating the non-conformities the control or good's tests need to be re-done.
The results of these controls and tests must be documented.
The records should contain:
- a description of the good;
- date of production;
- adopted testing methods;
- test's result;
- acceptance criteria;
The records should be signed by an authorized person,
who conducts the control or tests.
In the case of results incompliant with the requirements,
one should write down the corrective actions that have already been taken in order to eliminate the non-conformity.
The producer is responsible for keeping and storing records of the individual goods or goods' batches,
including the records of whom were these goods or batches of goods sold to for the first time.
The requirements regarding Company Production Control of the specified type of contraction goods are or will be specified in technical specifications,
harmonized with the directive - on harmonized standards or European technical approbation.
Functioning of the Company Production Control is a necessary element in conducting an assessment of the good's compliance,
before introducing it to circulation and usage.
Only goods,
which are compliant with the harmonized European standards,
European technical approbations or country technical arrangements,
recognized at the EU level,
can be introduced to the European market.
Compliance with these technical arrangements should be confirmed by a compliance certificate,
issued by the producer.
If the producer of construction goods does not have Company Production Control,
he may not issue a conformity declaration.
